Management of the General Registrar of Intellectual Property

 

Sudan is one of the countries that have known intellectual property since ancient times. It has an old legal basis founded on a principle that has been based on all divine legislation. It is that man possesses what is creative and this is required by common sense and rules of justice and equity.

  The interest in the protection of intellectual property rights has been affirmed by international conventions and national laws of countries. At the national level, the constitutions of the Sudan that followed have focused on intellectual production and codification.

The Constitution of the Sudan in 1998 states that each person has the right to gain money and thought and has the specificity of ownership for what he has earned, as stipulated in the Interim Constitution of 2005, article 39 thereof Every citizen has the right not to restrict the freedom of expression, to receive and disseminate information and publications, and to access the press without prejudice to public order, safety and morals, in accordance with the law.

it also calls for the promotion of intellectual property in accordance with the Universal Declaration of Human Rights adopted by the United Nations in 1948, which calls for the protection of the moral and financial interests resulting from scientific, literary or artistic production in the second paragraph of Article XXVII.

Intellectual property is divided into two parts:

Industrial property includes trademarks, service marks, inventions, industrial models, geographical origin data and trade names.

Section II copyright and neighboring rights, which includes literary and artistic works such as novels, poems, plays, films, musicals, drawings, solar panels, statues and computer programs.

It includes rights related to copyright, performers, the rights of producers of phonograms relating to their recordings, and the rights of broadcasting organizations related to radio and television programs.

Tasks of the Registrar of Intellectual Property:

1. National registration of trademarks and service marks.
2. National patent registration.
3. National registration of industrial models.
4. International registration of trademarks and service marks in accordance with the Madrid System (Agreement + Protocol)
5. Regional registration of patents and industrial designs.
6. International patent registration under the PCT.
7. Internal and external representation in regional and international industrial property meetings.
8. Recording all subsequent acts of waiver, use licenses and other subsequent conduct after registration and acquisition of protection.
9. Issuing certificates of registration of trademarks, patents and industrial designs.
10- Receive applications for regional and international protection of trademarks, service marks, patents and industrial designs in accordance with the regional and international conventions to which Sudan is a member.
11. Provide advice to the Minister of Justice and State organs on any matter relating to intellectual property
